REGISTRATION OF INTERNATIONAL NGO IN TANZANIA

The establishment, registration and affairs of Non-Governmental Organizations in Tanzania are regulated by the Non-Governmental Organizations Act, No.24 of 2002 as amended by Act No. 11 of 2005 and its Regulations of 2004.

The procedure for registration of a national and International NGO in Tanzania, even if it is an International NGOs, begins at the local government levels namely the Ward and District Council within which the main office of the NGO shall be situated. At all these levels, all documents relating to the NGO such as the Constitution of an NGO, Minutes containing full names and signatures of founder members, personal particulars of office bearers (Chairperson, Secretary and Treasurer with 2 photograph each), the address and physical location of the office must be provided.

At this level, the local government officers will vet the information submitted and carry out physical verification of existence of the office and submit their findings and recommendation to the District Council. The District Council shall vet the records and constitution of the NGO to see if its objectives is are not against government policy or any other law. Once certified, the District Commissioner will issue a letter of recommendation to the National NGO Registrar for registration.

PROCEDURAL REQUIREMENTS

The applicant for International NGO also has to undergo the same procedure described above. Other requirements are provided are provided under the provisions of section 12(3) of Act. No.11 of 2005.

REGULATORY REQUIREMENTS (Membership Requirements)

International NGO requires a minimum number of five or more persons at the time of registration. However, NGOs in Tanzania are member based; hence the number of members can increase accordingly as per the need by the organization. It is important to note that, depending of the constitution of the organization, founder members and office bearers are two different things and there is nothing like a local board. The two resident persons are appointed to be part of the team. When they are also office bearers eg Chairperson, Secretary or Treasurer, principally are considered as employees of the organization. They are not part of the Board. They are actually responsible to the Board. It has to be understood that the Board of the organization including an International NGO is one in the country of origin unless the organization decides otherwise.

Once the Registrar is satisfied with the application, will issue a CERTIFICATE OF COMPLIANCE

the same as the Certificate of Registration.

POST REGISTRATION REQUIREMENTS

All registered NGOs including INGOs are required to pay fees annual, prepare annual report of its activities and audited financial reports that shall be made available to the public and other all stakeholders as required by Section 29 of the

Ngo Act No.24 of 2002. Annual report must be submitted as per form No.13 TIMELINE FOR REGISTRATION IN MAINLAND TANZANIA

The procedure for registration of NGO in Tanzania takes a minimum of 21 to a maximum of 60 days.
